SEMECCEL is the operating company for the Cité de l’espace and L’Envol des Pionniers (hereinafter referred to as “the Sites”). SEMECCEL is also a travel agent and is registered under number IM031100035 with the Registre des Opérateurs de Voyages et de Séjours, registration renewed on 02/07/2019. Its head office is located at Cité de l’espace, avenue Jean Gonord BP 25855 31506 Toulouse Cedex 05. It is the customer’s sole contact and is answerable to the customer for the performance of the obligations arising from these conditions of sale.
The information appearing on the home page of the sites, in the brochures or on the websites www.cite- espace.com or lenvol-des-pionniers.com may be subject to certain modifications. Customers are invited to refer to the latest version of the website before making any purchase.

Groups: The specific price conditions for groups only apply to groups of a minimum of 20 paying people who have made a prior reservation request to our services.

Minors: When visiting the Site as a family or in a group, children remain under the responsibility of their parents or carers, who must ensure that they are supervised at all times, even during guided or themed tours, educational workshops or any other activities taking place on the Site. In addition, for safety reasons, certain dynamic activities are only accessible to children who meet the criteria or limitations set out at the entrance to each activity.

SEMECCEL accepts no responsibility for minors and will not exercise any supervision over them, including with regard to the persons who may join them or their entry to and exit from the Site, whether or not accompanied by adults, and their identity will not be verified. These minors remain the sole responsibility of their parents, both for any damage they may suffer and for any damage they may cause to SEMECCEL or to third parties, whether visitors or not.

Minors under the age of 16 must be accompanied by a legal representative or another adult with the authorisation of their legal representatives in order to enter the Site. Minors over the age of 16 must either be accompanied in the same way as younger children, or have authorisation from their legal representatives. SEMECCEL reserves the right to check the existence of authorisations and to refuse access.

Protection of personal data: SEMECCEL may collect certain personal information and data from customers, such as, but not limited to, their first and last names, e-mail address, telephone number and address. This data is processed for the purpose of managing the order, access to the site and sending commercial offers if the customer has ticked the appropriate box when placing the order.

The processing is carried out under the responsibility of SEMECCEL and the data collected is intended for the exclusive use of the latter.

In accordance with current legislation, you have the right to access, rectify, delete and port your personal data. You also have the right to refuse processing or to request that it be restricted.

You also have the right to make a complaint to the CNIL if you feel that your rights have not been respected (contact details available at www.cnil.fr).

Applicable law and courts: These terms and conditions of sale are governed by French law. Failing amicable settlement, any dispute relating to their interpretation and/or performance shall be referred to the French courts.
Price: All our prices include VAT in Euros.

Composition of these terms and conditions: These terms and conditions are composed of two parts. The first part applies to consumers who are referred to here as “travellers” when purchasing tickets with accommodation and as “visitors” when purchasing tickets (including combined tickets for several sites or third party sites) without accommodation (1.). The second part applies to legal persons (2.).

1. TRAVELLERS AND VISITORS

This section presents the conditions applicable only to travellers (1.1.) who take precedence
(1.2.) which would be contrary to them.

1.1. Conditions applicable only to travellers (ticket(s) + accommodation)

The combination of travel services offered to you is a package within the meaning of Directive (EU) 2015/2302 and Article L.211-2 II of the Tourism Code.
You will therefore benefit from all the rights granted by the European Union applicable to packages, as transposed in the tourism code. SEMECCEL will be fully responsible for the proper execution of the package as a whole.
In addition, as required by law, SEMECCEL has protection to refund your payments and, if transportation is included in the package, to ensure your repatriation in case it becomes insolvent.

I – Traveller Rights

> Essential rights under Directive (EU) 2015/2302 transposed into the Tourism Code
Travelers will receive all essential package information before concluding the package travel contract. The organizer and the retailer are responsible for the proper performance of all travel services included in the contract.
Travelers receive an emergency phone number or contact information to reach the organizer or retailer. Travelers may transfer their package to another person, with reasonable notice and possibly subject to additional charges.

The price of the package can only be increased if specific costs increase (for example, fuel prices) and if this possibility is explicitly provided for in the contract, and in any case cannot be changed less than twenty days before the start of the package. If the price increase exceeds 8% of the package price, the traveller may terminate the contract. If the organizer reserves the right to increase the price, the traveler is entitled to a price reduction in case of reduction of the corresponding costs.

Travellers may terminate the contract without paying a resolution fee and be fully reimbursed for payments made if any of the essential elements of the package, other than the price, is materially changed. If, before the start of the package, the professional responsible for the package cancels it, travelers can get the refund and compensation, if necessary. Travellers may resolve the contract without paying a resolution fee prior to the start of the package in exceptional circumstances, for example if there are serious security issues at the destination that may affect the package.

In addition, travellers may, at any time before the start of the package, terminate the contract by paying an appropriate and justifiable resolution fee.
If, after the start of the package, important elements of it cannot be provided as planned, other appropriate services will have to be offered to travelers, without additional cost. Travelers can terminate the contract without paying a resolution fee when the services are not performed in accordance with the contract, it significantly disrupts the performance of the package and the organizer does not remedy the problem.
Travellers are also entitled to a price reduction and/or compensation in case of non-performance or improper performance of travel services.

The organizer and the retailer must help the traveler if he is in difficulty.
If the organizer or retailer becomes insolvent, the amounts paid will be refunded. If the organiser or retailer becomes insolvent after the start of the package and the transport is included in the package, the repatriation of the passengers is guaranteed.

SEMECCEL has taken out insolvency protection with GROUPAMA ASSURANCE CREDIT & CAUTION, 126 rue de la Piazza – 93 199 Noisy-le-Grand Cedex, France – caution@groupama-ac.fr – 0892976781. Travellers may contact this organization if services are refused due to the insolvency of SEMECCEL.

> Other rights of the traveller
SEMECCEL has taken out professional liability insurance N°4355865P with the company MAIF, 79018 Niort Cedex, providing for the following amounts: personal injury up to € 15,000,000 per claim, consequential material and immaterial damage amounting to €3,500,000 and non-consecutive intangible damage amounting to €500,000 per calendar year.

To request assistance if the traveller is in difficulty or to complain about any non-compliance found during the execution of the trip or stay, the traveller can contact SEMECCEL, Cité de l’espace, avenue Jean Gonord BP 25855 31506 Toulouse Cedex 05. The traveler is required to communicate any non-compliance he finds during the execution of the trip or stay in accordance with II of article L. 211-16 of the tourism code.

Assignment of the contract: The traveler may assign his contract to an assignee who meets the same conditions as him to carry out the trip or stay, as long as this contract has not produced any effect. The transferor is required to inform SEMECCEL of his decision by any means allowing to obtain an acknowledgement of receipt no later than seven days before the beginning of the trip. The transferor of the contract and the transferee are jointly and severally liable for the payment of the balance of the price as well as any additional costs, fees or other costs that may arise from such assignment. The SEMECCEL informs the assignor of the actual costs of the assignment and provides the assignor with proof of the costs, royalties or other additional costs incurred by the assignment of the contract.

II – Accommodation

The price of the package does not include the tourist tax which may be requested in addition directly by the host and does not include travel between the Site and the place of accommodation.
The reservation request must systematically indicate the staff, the category of the public, the day of the departure date.

For group bookings: Reservations must be made no later than 45 days before the visit date. Payment of the balance of the contract price must be made in full no later than D-8. In this case, a voucher will be sent no later than 6 days before the date of your visit. This voucher must be presented to the various service providers.

Occupants of the rooms: Each accommodation is provided for a specific number of occupants and can in no case be inhabited by a greater number of people. A toddler is considered a full occupant. Unless otherwise agreed by SEMECCEL in writing, pets are not accepted (except guide or assistance dogs).

Arrival after 6 pm: in this case, the traveler must directly notify the host whose contact details appear on the visit documents.

Modification or cancellation of the contract: see part “V.3 Accommodation or other external services” of part “V – Modification or cancellation” of these conditions.

III – Responsibility of SEMECCEL

Except personal injury, intentional or negligent damages, any damages due by SEMECCEL are limited to three times the total price of the stay.

1.2. Common conditions for travellers (ticket(s) + accommodation) and visitors (tickets without accommodation)

The following conditions apply to both travellers and visitors, subject, for travellers, to the provisions of the previous section “Conditions applicable only to travellers” which systematically take precedence over common conditions which would be contrary to them.

I – Contractual relations

The customer acknowledges having the ability to contract under the conditions described in the conditions of sale presented below, ie to be at least 18 years old, to be legally able to contract and not to be under guardianship or curatorship. Any minor child must be accompanied by an adult. Upon arrival at one of the sites (La Cité de l’espace, L’Envol des Pionniers or any other third-party site to which the purchase of a ticket would give access), the customer is subject to the rules posted in the reception hall and accessible on the website of the Site concerned: Internal Rules.
The prices appearing in the brochures issued by SEMECCEL or on the website of the Site concerned correspond to the rates in force on the day of their edition. These prices can be changed at any time.
Once the contract is concluded, SEMECCEL cannot retroactively apply discounts and promotional offers.

II – Booking

II.1 – Individual

> Conclusion of the contract
The reservation must include the number of participants, the age of the participants, the day of arrival and the chosen services (including the number and type of rooms), the payment methods and cancellation conditions.
Reduced rates (student, disabled, family, etc.) are not available online. To benefit from this, the client must contact SEMECCEL or make a request to the hostesses of the Site concerned on the day of the visit.

> Purchase on website
The contract is valid upon validation of the payment and obtaining a file number. The reservation file is sent by email to the customer. If they do not receive it, it is up to them to contact SEMECCEL by email at resaweb@semeccel.com.
In case of refusal of payment by the Internet banking server, the file is cancelled and it is recorded as a quote.Visiting documents

Visiting documents include entrance tickets, hotel vouchers and other services. Entrance tickets allow direct access to the Site concerned. The other documents must be given to the providers concerned.
The client must present himself on the day mentioned on the visit documents.
After full payment of all services and receipt by email of the visit documents, the customer must print the visit documents (he undertakes in this case to respect the conditions of printing, validity and use of the said documents indicated below) or present them via his mobile terminal at the reception of the site.

> Printing conditions, validity and use of visiting documents

Printing:
The home visit document printing feature allows you to print the documents on a regular printer from an Internet access. The visit documents can be printed or presented in electronic format.

Validity of printed visit documents:
The customer must ensure that the printed visit documents have a good print quality. These visiting documents must imperatively correspond to the following conditions of validity: Printing in portrait mode, without modification of the size of print, on a blank white A4 sheet, front and back. Each person booked corresponds to a ticket, the documents corresponding to the other services being also materialized in a specific way. It is imperative to print all visiting documents.

Visiting documents and in particular partially printed, soiled, damaged or illegible tickets and vouchers will not be accepted and considered invalid. In case of poor print quality, the customer must reprint his ticket and/ or any other printable document in order to have a good print quality. The customer will be able to check the quality of the print by ensuring that the information written on the ticket and/or other documents as well as the barcode are clearly legible.

Use of printed visit documents:
Each entry ticket is provided with a unique barcode and/or QR code controlled and registered at the entrance of the relevant Site using barcode readers, allowing direct access to the relevant Site. Visit documents are personal and non-transferable. Unless otherwise provided in these conditions, they are neither exchangeable nor refundable. During the controls at the entrance of the Site concerned or the delivery of any other document of visit to the service providers involved in the course of the stay, An official and valid identity document may be requested from the customer to identify the buyer of said visit documents.
It is strictly forbidden to reproduce, duplicate or counterfeit an entry ticket or any other visit document, to make them available for such purposes or to use copies of these documents. Such facts may be subject to criminal prosecution, without prejudice to the damages that SEMECCEL would be entitled to claim from the offenders based on the harm suffered.

II.2 – Groups

> Booking
The group-specific fare conditions and the conditions below apply to groups of a minimum of 20 paying people (or 10 students for school groups) who have made a prior reservation request with our services.
The reservation must include the number of participants, the age of the participants, the day of arrival and the chosen services (including the number and type of rooms), the payment methods and cancellation conditions.
All reservations must be made by email, no later than three weeks before the date of visit. The reservation request must systematically indicate the number of people, the category of the public and the day or days of the visit. The contract will be sent by email by the Booking Service.

The reservation confirmed by email implies the unrestricted acceptance by the customer or his representative of these conditions. A signed copy must be kept by the client, and presented on the day of the visit.
The reservation becomes firm upon receipt by SEMECCEL of the duly signed contract and the 50% deposit before the option end date, or the Purchase Order for the administrations: otherwise, the options will not be maintained. For reservations with catering, the choice of the menu must accompany the signed contract. Otherwise and without specifying 15 days before the date of visit, SEMECCEL will be forced to establish menus without the advice of the customer.
The 50% deposit or purchase order for administrative payments must be sent to us before the option end date at the same time as the signed contract.
The schedules of shows, entertainment, shops and restaurants mentioned in the contracts are indicative and can be modified or deleted without notice.

>Administration costs

An application fee of € 23 is charged on each application for any reservation of at least one stay with or without accommodation, except in the case of educational visits. For educational visits, a modification fee of 30 € is charged from the 2nd modification made on the same file.

III – Terms of Payment

SEMECCEL is not responsible for any fees on bank card transactions caused by the change in the exchange rate or for other reasons not dependent on SEMECCEL.

III.1 – Individual
> Payment on site (at checkout)
All payments must be made in euros.
> Booking on website
All payments must be made in euros by Credit Card, Visa, Visa Electron, Mastercard, American Express, or E-card Bleue.

III.2 Groups
The balance of the price is due on the day of the visit, on the arrival of the group, with the exception of the by-laws. A deferred payment, upon receipt of the invoice, may possibly be agreed upon with the commercial management. Any amount not paid by the contractual deadline will result in the application of late penalties calculated on the basis of 3 times the legal interest rate in force.

IV – No right of withdrawal

Pursuant to Article L 221-28 of the Consumer Code, the services offered by SEMECCEL are not subject to the application of the right of withdrawal provided for in Articles L 221-18 and following of the same Code in respect of contracts concluded at a distance.
Therefore, the services ordered are exclusively subject to the cancellation and modification conditions provided for in these general conditions.

V – Amendment or Cancellation

V.1 Individual

>Modification or cancellation by the customer

Requests for modification, total or partial cancellation of a confirmed file can only be made to SEMECCEL (even for a file reserved on the website) and must be notified to SEMECCEL in writing by registered letter, by fax to 05 62 71 56 01 or by e-mail to resaweb@semeccel.com and received by SEMECCEL no later than D-4 before the date of visit. As part of promotional offers, tickets are neither exchangeable nor refundable.
Any change in the date of stay or hotel establishment requested by the customer before arrival constitutes a cancellation of the initial reservation (with application of the cancellation fee described in the following paragraph) and a record of the new order under the conditions described above.
For any request for total or partial cancellation of a confirmed file, the amount retained by SEMECCEL is as follows:

No refunds are made at the cash registers.
Delayed arrival, waiver or early departure
In case of arrival before or after the date of the first booked service or if he renounces one of the services of his stay or in case of early departure during the stay, the customer does not benefit from any refund.

No-show

No-show does not entitle the customer to a refund.

V.2 Groups
Requests for changes to confirmed records must be made in writing by email to resa@semeccel.com or seminaires@semeccel.com. Only modifications notified by reference of a contract by SEMECCEL are accepted.
The exact number of people present on the day of the reservation (room rentals, catering and other) must be confirmed in writing no later than 15 days before the start of the event. This number will be retained as the minimum billing basis.
No correction made directly by the client on a SEMECCEL document will be taken into account.

SEMECCEL deadline:
Mail: the date of receipt is proof.
Email/ Fax: reception before 17:00, local time, excluding weekends and holidays.

The number of employees indicated during the booking or the last modification will be retained as the basis of billing.  It is tolerated up to 10% absentees applicable on all services, except in the context of space rental. Beyond this rate, all services will be billed for the rest of those not present.
For any modification to the increase received between D-15 and D the SEMECCEL will not be able to guarantee the reservations or additional services.

>General services (ticketing and shows):

Any cancellation or modification will be invoiced based on the total price of the service under the following conditions:

> Ancillary services (discovery visits, guided visits, thematic visits, educational workshops, etc.):
Within a period of less than D-15, in the event of a reduction in the number of members of a group resulting in the cancellation of one of the services mentioned above (for example the cancellation of one of the two guided tours initially planned for two sub-groups), said service will be invoiced in its entirety.
Any restoration service not consumed may not give rise to a reduction in the price of the service.

Any cancellation or modification will be invoiced based on the total price of the service under the following conditions:

V.3 Accommodation or other external services

It is specified that a tourist tax may be requested in addition directly by the host. Changes are made by SEMECCEL subject to availability. Any change of date of stay or hotel establishment requested by the customer constitutes a cancellation of his initial order with application of the cancellation fees described below. Any changes will result in a new contract. In the absence of return of the new contract signed before the option end date and the additional regulation if necessary, the changes are considered null
Total cancellation of the file due to the client
For any total cancellation, the SEMECCEL reserves the right to deduct part of the total amount of the service booked by the customer under the conditions below:

Partial modification of the file due to the client
For any partial modification (number of rooms, etc.), SEMECCEL reserves the right to deduct part of the total amount of the service booked by the customer under the following conditions:

Delayed arrival, waiver or early departure
In case of arrival before or after the date of the first booked service or if he renounces one of the services of his stay or in case of early departure during the stay, the customer does not benefit from any refund.
No-show
No-show does not entitle the customer to a refund.

V.4 Modification or cancellation by a supplier
In the event that a reserved file is modified on an essential element or cancelled by SEMECCEL, the customer must, within 8 days after being informed in writing, either terminate his reservation and obtain the refund, accept the proposed amendment by signing an amendment to the contract.

VI – Mediation
In the event of a complaint not resolved by an oral exchange, the customer is invited to send a formal written request to SEMECCEL at the address at the top of these conditions. He can then, if necessary, contact the tourism and travel mediator by following the procedure described on the following website: www.mtv.travel. This article does not prevent the customer from freely seizing a jurisdiction at any time.

2. LEGAL ENTITIES

2.1. Reservations
For any group reservation, seminar or space rental, the booking conditions and the file fees are those specified in “II.2 – Groups” of part “1.2. Common Conditions for Travellers and Visitors” of these Terms.

2.2. Purpose
Commercial events, exhibitions, representations organized by the customer may only take place within the premises of the Site concerned after obtaining the approval or authorization of the competent official authorities.
Any musical event must be the subject of a prior statement from the customer to the SACEM, 7 esplanade Compans Cafarelli 31000 Toulouse. Tel: 05 62 27 93 80.
The SEMECCEL may unilaterally terminate without notice or compensation, any contract whose subject or cause would be incompatible with the destination of the rented premises, or contrary to morality, or likely to disturb public order.

2.3. Payment
The SEMECCEL may cancel the reservation without compensation, after simple formal notice remained without effect, in the absence of payment by the customer of all or part of the deposit to be paid to the confirmation.
In case of late payment, the customer will be liable for late payment penalties calculated on the basis of 3 times the legal interest rate in force. In addition, the customer will be liable by right to the SEMECCEL of a flat-rate compensation of 40 euros for costs of recovery of amounts due

2.4. Organization
The customer will not be able to bring any food or drink from the outside, without having obtained an exceptional exemption from the SEMECCEL. The latter reserves the right to impose a cork duty.
Any project of technical installation, various layout of the rooms and animation, will be submitted for review and agreement before the confirmation of the file. At the end of the contractual period of use of the premises, the customer shall have the various materials, effects, documentation and equipment, whatever they may be, brought at his request to the premises of the Site concerned for the performance of the contract.
The customer undertakes to return all the rented equipment. In case of damage or no return, the cost of replacement will be due to SEMECCEL.

2.5. Consommation, modification, annulation
Toute prestation de restauration non consommée ne pourra donner lieu à une minoration du prix de la prestation.
Toute annulation ou modification de lieu d’espace fera l’objet d’une facturation basée sur le prix total de la prestation, dans les conditions suivantes :

Les services autres que la location d’espace sont modifiables ou annulables dans les conditions décrites dans V.2 Groupes.

2.6. Non-conformité – Difficultés financières – Réclamation
Toute réclamation relative à un séjour doit être adressée à la SEMECCEL par lettre recommandée à AR dans les 72 heures suivant le service ou le séjour. Afin d’éviter tout litige, les pièces justificatives (contrat, billets d’entrée, bons, etc.) contenant le nombre de participants doivent être jointes à la plainte.

2.7. Responsibility
SEMECCEL cannot be held responsible for damages resulting from force majeure, due to the customer
or any third party to the organization, violating the course of the stay and the services provided to this
occasion.
The SEMECCEL declines all responsibility for damages of any kind and, in particular, fire and/ or theft, likely to affect the effects, objects or materials brought by visitors, that have not been deposited in the premises reserved for that purpose.
The signatory of the contract is responsible for any direct or indirect damage that one of its members may cause during his presence in the park or building and undertakes to take out insurance in this regard.
